1. AGREEMENT TO TERMS

By accessing or using the Beer Me In mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Petr Pucek ("we," "us," or "our"), the developer of Beer Me In.

2. ELIGIBILITY AND AGE RESTRICTION

You must be of legal drinking age in your jurisdiction to use this App. By using Beer Me In, you represent and warrant that you are at least 18 years old (or the legal drinking age in your country, whichever is higher).

We do not knowingly collect information from or direct any of our content specifically to anyone under the legal drinking age. If we learn that we have collected personal information from someone under the legal drinking age, we will delete that information as quickly as possible.

3. ACCOUNT REGISTRATION

3.1 Account Creation

To use Beer Me In, you must create an account using one of the following methods:

• Apple Sign In (for iOS users)
• Google Sign In (for Android users)

During registration:

• Providing your email address is optional
• You must choose a username, which will be your display name in the App
• You agree to provide accurate and current information

3.2 Username

Your username is required and must be unique. You may change your username at any time if you have a PRO account. We reserve the right to reject or remove usernames that violate these Terms or are deemed inappropriate.

3.3 Account Security

Your account is secured through Apple Sign In or Google Sign In. You are responsible for:

• Maintaining the security of your Apple ID or Google account
• All activities that occur under your Beer Me In account
• Notifying us immediately of any unauthorized use of your account

3.4 Account Deletion

You may delete your account at any time through the settings screen in the App. Upon deletion, all your data will be permanently removed from our systems in accordance with our Privacy Policy.

4. DESCRIPTION OF SERVICE

Beer Me In is a beer logging and tracking application that allows users to:

• Log and count beer consumption
• View insights and statistics about their drinking habits
• Create a profile with a custom username
• Connect with other users by adding friends
• View beer logging activity of friends and other users
• Access leaderboards
• Subscribe to AI-powered features (with subscription)
• Purchase PRO account features (one-time purchase)

5. SUBSCRIPTIONS

5.1 Subscription Features

Subscribers gain access to AI-powered features including:

• Daily or weekly summaries
• Personal beer coach tips
• User comparisons
• Humorous roasts
• Hangover predictions
• Creative excuse generator

5.2 Subscription Plans

We offer the following subscription options:

• Monthly subscription
• Yearly subscription
• 7-day free trial for new subscribers

5.3 Free Trial

New users are eligible for a 7-day free trial. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

5.4 Automatic Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

5.5 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

5.6 Price Changes

We reserve the right to change subscription prices at any time. Price changes will apply to new subscriptions and renewals after the change takes effect. We will provide advance notice of price increases.

6. PRO ACCOUNT (ONE-TIME PURCHASE)

6.1 PRO Features

A PRO account unlocks additional features including:

• Enhanced statistics
• Ad-free experience
• Ability to log multiple beers at once
• Ability to change your username
• Theme customization
• Custom title before username
• Additional features for an improved user experience

6.2 Purchase Terms

The PRO account is a one-time, non-recurring purchase. Once purchased, PRO features remain active for the lifetime of your account.

6.3 No Refunds

All purchases are final. We do not offer refunds for the PRO account purchase except as required by applicable law or Apple's refund policies.

7. USER CONDUCT

You agree to use Beer Me In only for lawful purposes. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Impersonate another person or entity
• Use another user's account without permission
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use automated systems (bots, scripts) to access the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Use the App to promote excessive or harmful alcohol consumption
• Choose usernames that are offensive, misleading, or infringe on others' rights

8. USER PROFILES AND SOCIAL FEATURES

8.1 Usernames

You may choose a custom username for your profile. We reserve the right to remove or change usernames that violate these Terms or are deemed inappropriate.

8.2 Profile Visibility

Your profile, including your username and beer logging activity, may be visible to other users of the App.

8.3 Friend Connections

You may add other users as friends. Adding someone as a friend allows you to view their beer logging activity.

8.4 Leaderboards

Your activity may appear on public leaderboards within the App. By using the App, you consent to this display of your activity.

9. INTELLECTUAL PROPERTY RIGHTS

9.1 Our Rights

Beer Me In, including all content, features, functionality, software code, design, graphics, and the "Beer Me In" name and logo, are owned by Petr Pucek and are protected by copyright, trademark, and other intellectual property laws.

9.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

9.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Sell, rent, lease, or sublicense the App
• Redistribute or make the App available over a network
• Use the App for commercial purposes without our written permission

10. HEALTH AND SAFETY DISCLAIMER

IMPORTANT NOTICE: Beer Me In is designed for tracking and entertainment purposes only. The App and its AI features are not intended to provide medical advice, diagnosis, or treatment.

• The App does not encourage excessive alcohol consumption
• Always drink responsibly and in accordance with local laws
• If you have concerns about your alcohol consumption, please consult a healthcare professional
• The AI predictions and summaries are for entertainment purposes only and should not be relied upon for health decisions
• We are not responsible for any health consequences resulting from alcohol consumption logged in the App

11. DATA AND PRIVACY

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. THIRD-PARTY SERVICES

The App uses the following third-party services:

• Apple Sign In for authentication (iOS users)
• Google Sign In for authentication (Android users)
• Apple's In-App Purchase system for subscriptions and purchases
• Google AdMob for serving advertisements (for non-PRO users)

Your use of these services is subject to their respective Terms and Conditions and Privacy Policies. We are not responsible for the practices or policies of these third-party services.

13. MODIFICATIONS TO THE APP

We reserve the right to modify, suspend, or discontinue the App or any features at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

14. TERMINATION

14.1 Termination by You

You may terminate your account at any time by deleting your account through the settings screen.

14.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users, us, or third parties
• Violates applicable laws or regulations
• Is fraudulent or involves abuse of the App's features

14.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• Your account data will be deleted in accordance with our Privacy Policy
• Active subscriptions may continue until the end of the paid period (no refunds for partial periods)
• PRO account purchases are non-refundable

15. DISCLAIMERS AND LIMITATION OF LIABILITY

15.1 "AS IS" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

15.2 No Guarantee

We do not guarantee that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected
• AI-generated content will be accurate, appropriate, or useful

15.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETR PUCEK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of your account
• Any content obtained from the App
• Any health consequences related to alcohol consumption
• Decisions made based on AI-generated content

15.4 Maximum Liability

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Petr Pucek from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

17. GOVERNING LAW AND DISPUTE RESOLUTION

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.

17.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

17.3 Informal Resolution

Before filing any formal legal action, you agree to first contact us to attempt to resolve any disputes informally.

18. LEGAL COMPLIANCE AND USER REPRESENTATIONS

By using Beer Me In, you represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country;
• You are not listed on any U.S. Government list of prohibited or restricted parties;
• You will comply with all applicable local, state, national, and international laws and regulations in your use of the App;
• You are of legal drinking age in your jurisdiction.

19. APPLE-SPECIFIC TERMS

19.1 Acknowledgment

You acknowledge that these Terms are between you and Petr Pucek only, not with Apple Inc. ("Apple"), and that Apple is not responsible for the App or its content.

19.2 Scope of License

The license granted to you is limited to a non-transferable license to use the App on any Apple device that you own or control as permitted by Apple's App Store Terms of Service.

19.3 Maintenance and Support

Petr Pucek is solely responsible for providing maintenance and support services for the App. Apple has no obligation to provide any maintenance or support services.

19.4 Warranty

Apple is not responsible for any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.

19.5 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple will have the right to enforce these Terms against you as a third-party beneficiary.

20. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date at the top of these Terms
• Providing notice through the App
• Sending an email to the address associated with your account (if applicable)

Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

21. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

22. WAIVER

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

23. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Petr Pucek regarding the use of Beer Me In and supersede any prior agreements.

25. LANGUAGE

These Terms may be translated into other languages for your convenience. In the event of any conflict between the English version and a translated version, the English version shall prevail.

By using Beer Me In, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
